Karen has been a celebrant for 15 years, nine years in Brisbane and the past six years on the Sunshine Coast, Queensland performing weddings on beaches, in rainforests, the hinterland and magnificent reception venues. Her contribution as a former Treasurer of the ACMCQ, sharing unusual experiences for newsletters, opinions on celebrancy matters and arranging coffee meetings for new and experienced in her area has been appreciated.

Karen has presented ongoing professional development on behalf of the AG Department on the Sunshine Coast. She has first hand experience with the fiancé visa program having sponsored her own husband into the country, and has also worked at an overseas Consular office.

A few years ago, after 12 years of celebrancy, and over 600 couples later, something out of the ordinary pops up, which makes our job even more interesting!

Decree of Nullity

A Decree of Nullity was produced as evidence of termination of previous marriage. On the NOIM the groom had left the “conjugal status” blank, but had completed all the details in the Sections 13-18 of the NOIM (with the previous marriage date recorded.) The Family Court approved the nullity several months after the marriage on the grounds:

“that the consent of the wife to the marriage was not a real consent because the wife was mentally incapable of understanding the nature and effect of the marriage ceremony.”

As this was the first “Nullity” I had come across, I was a little baffled as to what to include on the NOIM.

I must admit, the case certainly piqued Peter Jones’ interest too, being 20 years since he had seen a “nullity”. It was determined to include “never validly married” in the conjugal status section, with the word, “validly” really coming into its own in this case! The court date was to be included as the date of nullity, not the date of the “invalid marriage”, and on Page 4 of the form, “nullity” was to be circled with the usual court markings.
